Peritumedia operates as a digital marketing and creative agency offering:

• Social Media Management
• Paid Advertising (Meta/Google Ads)
• Branding & Graphic Design
• Photography & Videography
• Content Creation & Copywriting
• Digital Strategy & Consulting

3. Client Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a contract
• Provide accurate business information
• Have authorization to make decisions for the business/organization

4. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your business
• Provide necessary access to social media accounts (if applicable)
• Respond to our requests for feedback or approvals in a timely manner
• Use services for legitimate business purposes only
• Not share confidential strategies or materials provided by us

5. Pricing and Payment Terms

5.1 Service Packages

We offer three main packages:

• Starter Presence: R3,500/month (estimated)
• Growth Accelerator: R7,500/month (estimated)
• Digital Dominance: Custom pricing

* These are estimated prices. Final actual charges may vary based on specific project requirements.

5.2 Payment Terms

• Payments are due in advance for monthly services
• We accept electronic transfers and major credit cards
• Late payments may result in service suspension
• Prices are subject to change with 30 days' notice

5.3 Refund Policy

Refunds are considered on a case-by-case basis. Monthly subscriptions are non-refundable after the first 7 days of service commencement.

6. Project Timelines and Deliverables

Project timelines vary based on scope and complexity. We will provide estimated delivery dates during the consultation phase. Delays caused by client-side factors (late feedback, missing assets, etc.) may impact final delivery dates.

7. Intellectual Property Rights

Intellectual property rights are handled as follows:

• Client Materials: Client retains ownership of all materials provided to us
• Our Creations: We retain ownership of our methodologies, tools, and proprietary systems
• Final Deliverables: Upon full payment, client receives usage rights for final deliverables
• Portfolio Rights: We retain the right to showcase completed work in our portfolio

8. Confidentiality

Both parties agree to keep confidential information private. This includes business strategies, financial information, client lists, and proprietary methodologies. Confidentiality obligations survive termination of services.

9. Limitation of Liability

To the fullest extent permitted by South African law, Peritumedia shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for services in the preceding 12 months.

10. Termination of Services

Either party may terminate services with written notice:

• Client Termination: 30 days written notice for monthly contracts
• Our Termination: We may terminate for breach of terms, non-payment, or unethical behavior
• Outstanding Fees: All outstanding fees remain payable upon termination

11. Digital Creator Network

For creators joining our network:

• Creators are independent contractors, not employees
• We facilitate connections with clients
• Creators are responsible for their own tax obligations
• We take a commission on facilitated projects
• Separate creator agreement required

12. Dispute Resolution

Any disputes shall first be resolved through mediation in Johannesburg, South Africa. If mediation fails, disputes shall be settled in accordance with South African law in the appropriate courts of Gauteng.

13. Changes to Terms

We may modify these terms at any time. Continued use of services after changes constitutes acceptance. We will notify you of material changes via email or website notice.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law principles.
